Rhode Center Co-Directors Nora Freeman Engstrom and David Freeman Engstrom write in support of an amendment to the Arizona Code of Judicial Conduct that would codify a statewide community justice worker (CJW) program. Several states have enacted such CJW programs, which generally authorize trained nonlawyers to provide free limited legal services to individuals facing civil legal issues within approved legal aid or community-based organizations. This Rhode Center comment, submitted to the Arizona Supreme Court and the Administrative Office of the Courts, details research studying the benefits and perils of nonlawyer assistance. What this research shows is that in many contexts, “trained nonlawyers can perform as well as, or sometimes better than, their J.D.-toting counterparts.” The comment also applauds Arizona’s leadership in the access to justice movement.
