The Reregulation of Utah: Managing Risk with Better Protections

The Utah Supreme Court launched a new era for legal services in America. For the first time in more than a century in the American legal industry, new business and capital structures and new service providers are allowed to offer legal services, including services considered to be the practice of law, to the public. The Utah reforms are unique in approach in that one of the primary goals is to develop a new regulatory framework for the regulation of legal services. The fundamental question guiding the Utah reforms is: How might we regulate to promote new legal businesses and services while also protecting consumers?
