Veterans with disabilities who experience discrimination are entitled to access to federal court for relief--just like anyone else. The VA, however, wants to close the courthouse doors. In this Ninth Circuit amicus brief, we explain why this is wrong and lay bare the Access to Justice implications. In support of unhoused veterans in their suit against the VA for its failure to provide meaningful access to housing and health care because of their disabilities, we break down why federal court is the only place where veterans can challenge unlawful systemic VA practices. Including that the VA disability benefits system simply can't hear systemic challenges such as the one brought by the veterans here. Federal court is the right--and only--forum to maintain Access to Justice.
